Monthly competition: Terms and Conditions
Please read these terms before nominating. Submitting a nomination means you accept them.
1. Promoter
1.1 The promoter is Melinda Boyd Holistics, ABN 91920760714, Shop 25, 301 Stanmore Road, Petersham NSW 2049 (“the Promoter”).
2. Eligibility
2.1 Nominators and nominees must be 18 years or older and live in New South Wales / Australia.
2.2 The nominee must be able to attend the Promoter’s clinic in person to redeem the prize.
2.3 The Promoter, its employees, contractors and their immediate family members, and the nominator are not eligible to be nominated or to win.
2.4 You can only nominate someone you know, and you must reasonably believe they would be happy to be nominated and contacted by the Promoter.
3. Cost to Enter
3.1 Entry is free. No purchase or payment is required, and buying a service from the Promoter does not improve your chances of winning.
4. How to Enter
4.1 Submit a nomination via link provided on www.melindaboydholistics.com website or texting or calling 0402 287 246 with the nominator’s name and contact details, the nominee’s name and contact details, and, if you like, a short note on why you’re nominating them.
4.2 Each nomination form or message may name one nominee only. You may nominate more than one person by submitting a separate nomination for each.
4.3 Each person may be nominated by the same nominator only once per month. Each valid nomination received counts as one entry in the draw.
4.4 Incomplete, unclear, automated or duplicate nominations are invalid.
5. Monthly Draws
5.1 There is one draw each calendar month (“Draw Month”).
5.2 Nominations received between the 1st and the last day of a month go into the draw held in the first week of the following month. Nominations received after a draw’s cut-off go into the next month’s draw only. They are not carried back into an earlier draw or entered into more than one draw.
5.3 The draw is conducted at random using an online ‘Wheel of Names’, https://wheelofnames.com/ lottery wheel on 1st day of each month.
5.4 Unsuccessful nominations are not carried forward into later draws.
6. Prize
6.1 One prize is awarded each month: a free 60-minute remedial massage valued at $150 (incl. GST), to be redeemed at Melinda Boyd Holistics in Your Integrative Health Clinic, Shop 25, 301 Stanmore Road, Petersham NSW 2049.
6.2 The voucher must be redeemed within the Draw Month in which it was won (by the last day of that month). Vouchers not redeemed within that month expire and have no cash value.
6.3 The prize is not transferable, cannot be exchanged or redeemed for cash, and cannot be combined with other offers.
6.4 Appointments must be booked in advance and are subject to availability. Late cancellations (less than 24 hours’ notice) or missed appointments may forfeit the voucher.
6.5 Any costs of attending (travel, parking and so on) are the winner’s responsibility.
6.6 If a prize cannot be provided for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.
7. Winner Notification
7.1 The winning nominee will be contacted within 3 business days of the draw using the details provided.
7.2 If the winner does not respond within 5 business days, the Promoter may redraw, as long as the new winner can still redeem within the Draw Month. If no eligible winner can be found, the prize may be withdrawn for that month.
7.3 The nominator will be told when their nominee has won, and the winner’s first name and suburb will be published on social media. See clause 10.
8. Health and Safety
8.1 The winner must complete a standard health history form before treatment.
8.2 The treating practitioner may modify, postpone or decline treatment if it is not safe or suitable for the winner’s health circumstances. In that case the Promoter may offer a suitable alternative of equal value, but no cash will be paid.
8.3 The prize is a complementary treatment and does not replace medical advice, diagnosis or treatment.
9. Disqualification and Changes
9.1 The Promoter may disqualify any nomination it reasonably believes to be false, fraudulent or made in breach of these terms.
9.2 The Promoter may suspend, change or end the competition if circumstances outside its control make that necessary. Any change will be published on Melinda Boyd Holistics website.
9.3 The Promoter’s decisions on the conduct of the competition are final, to the extent permitted by law.
10. Privacy
10.1 The Promoter collects the personal information of both nominators and nominees to run the competition: to contact nominees, conduct the draw, deliver the prize and announce winners.
10.2 Nominators must have a reasonable basis to believe the nominee would not object to their contact details being provided.
10.3 Personal information is handled in line with the Promoter’s Privacy Policy https://www.melindaboydholistics.com/privacy-policy.html and the Australian Privacy Principles. It is not sold or disclosed to third parties except as needed to run the competition or as required by law.
10.4 Details will not be used for marketing unless the person has separately opted in.
10.5 A nominator’s note will be shared only with the nominee and will not be published without the nominator’s and nominee’s consent.
10.6 The winner’s first name and suburb may be published only with the winner’s consent. Consent may be withdrawn by contacting melindaboydholistics@gmail.com
10.7 Nominators and nominees may request access to, or deletion of, their information by contacting melindaboydholistics@gmail.com
11. Liability
11.1 To the maximum extent permitted by law, the Promoter is not liable for any loss or injury arising from participation in the competition or use of the prize, except where caused by the Promoter’s negligence. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law.
12. Social Media
12.1 This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Participants release these platforms from any liability connected with it.
13. General
13.1 These terms are governed by the laws of New South Wales, and participants submit to the non-exclusive jurisdiction of its courts.
